If the Resident, or the Resident's guests, invitees, or contractors, cause damage, injury, loss, or a legal claim due to use of the Premises, negligence, or a breach of this Agreement, the Resident shall be responsible for and must pay all resulting damages, losses, claims, costs, and expenses, including reasonable attorneys' fees incurred by the Landlord. If the Resident defaults on or breaches this Agreement or is involved in any claim or court dispute arising from it, the Resident shall be responsible for paying all resulting costs and expenses, including reasonable attorneys' fees (whether or not a lawsuit is filed), any court-awarded fees if the Landlord is the prevailing party, and any outstanding amounts owed with interest at eighteen percent (18%) per year from the date due, excluding interest on late fees during the tenancy. Any damages due to smoking in the interior or exterior may be cause for lease termination and/or damage fees. Resident must pay for all utilities, related deposits, and utility transfer fee's. A posting fee in the amount of the actual cost incurred by Landlord will be assessed for any notice or demand served upon the Resident for default of Lease.
