1. A prospective tenant has the right to provide to the landlord a portable tenant screening report, as defined in section 38-12-902(2.5), Colorado Revised Statutes; and
2. If a prospective tenant provides the landlord with a portable tenant screening report, the landlord is prohibited from:
Charging the prospective tenant a rental application fee; or
Charging the prospective tenant a fee for the landlord to access or use the portable tenant screening report.
Section 24-34-502, Colorado Revised Statutes, prohibits source of income discrimination and requires a non-exempt landlord to accept any lawful and verifiable source of money paid directly, indirectly, or on behalf of a person including income derived from any lawful profession or occupation and income or rental payment derived from any government or private assistance, grant, or loan program. This subsection does not apply to a landlord with five or fewer single-family rental homes and no more than five total rental units including any single-family homes.
